First court hearing scheduled in Balfour Beatty fatality prosecution

The first court hearing of a health and safety prosecution following a worker fatality at AWE plc's Aldermaston site will be held next month. 

The plea and allocation hearing will take place at 10am on Wednesday 18 March, at High Wycombe Magistrates Court, it has been confirmed. 

Balfour Beatty Group Limited is charged with two health and safety offences following alleged breaches of the Health and Safety at Work etc. Act 1974 Section 2(1), and 3(1). 

The charges relate to an incident which occurred at the Aldermaston site in West Berkshire on 6 July 2023 when a 58-year-old male construction worker from East London died after sustaining fatal injuries. 

The decision to begin legal proceedings follows an investigation into the incident by the Office for Nuclear Regulation (ONR), the UK’s independent nuclear regulator. 

The incident was a conventional health and safety matter, and there was no radiological risk to the public. 

 As legal proceedings are active, ONR cannot provide further comment on the case at this time.
