The first court hearing will be held next month for the prosecution of a logistics company following a vending machine accident at a nuclear site that left a worker seriously injured.
XPO Transport Solutions UK Ltd is charged with an alleged breach of the Health and Safety at Work etc. Act 1974 Section 2(1) following the incident at Dungeness B Nuclear Power Station in Kent.
A plea and allocation hearing will take place at 10am on Tuesday 12 May, at Margate Magistrates Court.
The incident happened in March 2024, and left the XPO employee with serious leg injuries and requiring hospital treatment.
At the time, employees from the Northamptonshire-based logistics company lost control of the vending machine, which fell onto one of the workers while being moved down a staircase.
The decision to begin legal proceedings follows an investigation by the Office for Nuclear Regulation (ONR), the UK’s independent nuclear regulator.
The incident was a conventional health and safety matter, and there was no radiological risk to the public.
As legal proceedings are active, ONR is unable to provide further comment on the case at this time.
