Logistics company to appear in court for a health and safety offence following a vending machine incident

A logistics company will appear in Canterbury Crown Court on Tuesday 16 June following a vending machine incident at a nuclear power station which left a worker seriously injured.

The charge relates to an incident which occurred at Dungeness B Nuclear Power Station in Kent on 4 March 2024. 

Employees from the Northamptonshire-based company lost control of a vending machine, which fell onto XPO worker Paul Stanley, 65, from Kent, while it was being moved down a staircase. Mr Stanley sustained serious leg injuries. 

XPO Transport Solutions UK Ltd appeared at Margate Magistrates Court in May for a prosecution brought by the Office for Nuclear Regulation (ONR), the UK's independent nuclear regulator at which no plea was entered at that stage. 

XPO Transport Solutions UK Ltd is charged with failing to discharge its duty to ensure the health and safety of its employees, including Paul Stanley, in relation to the risks arising whilst undertaking removal work, whereby it is guilty of an offence contrary to Section 33(1) (a) under the Health and Safety at Work etc. Act 1974 Section 2(1).

The incident was a conventional health and safety matter, and there was no radiological risk to the public.  

As legal proceedings are active, ONR cannot provide further comment on the case at this time.
