The first hearing of a health and safety prosecution following a worker fatality at Hinkley Point C (HPC) nuclear construction site will be held at Bristol Magistrates Court at 2pm on Tuesday, October 14, it has been confirmed.
This is a plea and allocation hearing for three defendants - NNB Generation Company (HPC) Ltd (NNB GenCo), Bouygues Travaux Publics SAS and Laing O’Rourke Delivery Limited.
NNB GenCo, the principal contractor for the ongoing nuclear construction project, is charged with failing to plan, manage and monitor the construction phase and co-ordinate matters relating to health and safety during the construction phase to ensure that work was carried out without risks to health and safety, contravening Regulation 13(1) of the Construction (Design and Management) Regulations 2015.
Contractors Bouygues Travaux Publics SAS and Laing O’Rourke Delivery Limited are charged with failing to plan, manage and monitor to ensure that construction work was carried out without risks to health and safety, contravening Regulation 15(2) of the Construction (Design and Management) Regulations 2015.
The prosecutions relate to a fatal accident which occurred on the HPC site, near Bridgwater, Somerset, on 13 November 2022.
Site supervisor Jason Waring, 48, died in a construction incident after sustaining fatal injuries.
The decision to begin legal proceedings follows an investigation into the incident by ONR, the UK’s independent nuclear regulator.
Given that matters are now subject to legal proceedings, ONR is unable to comment further.
