Information requested
I write under the Freedom of Information Act 2000. Please could you send me the documents on nuclear security that supported the ONR GDA on the GE Vernova Hitachi SMR design?
Our response
In our initial response of 13 January 2026, we confirmed that under section 1 of the FOIA, we hold the information you requested.
We provided links to assessment reports relating to security that formed part of the Generic Design Assessment (GDA) for the GE Vernova Hitachi BWRX-300 Small Modular Reactor design, and identified nine additional documents within scope of your request.
Following further assessment, we confirm that all nine documents are being withheld.
Section 41 – Information provided in confidence
Section 41 provides an exemption where information is supplied in confidence and disclosure would constitute a breach of that confidence.
We consider that the security information relating to the GE Vernova Hitachi BWRX-300 SMR design has the necessary quality of confidence and was provided in circumstances giving rise to an obligation of confidence.
This is an absolute exemption and does not require a public interest test.
Section 24 – Safeguarding national security
Section 24 applies where withholding information is necessary to safeguard national security. Disclosure could make the UK or its citizens more vulnerable to threats.
Section 43 – Commercial interests
Section 43(2) applies where disclosure would, or would be likely to, prejudice the commercial interests of any party.
As sections 24 and 43 are qualified exemptions, a public interest test has been applied.

Factors for disclosure (sections 24 and 43)
- There is a commitment to openness and transparency to maintain trust in ONR as an independent regulator; and
- There is public interest in information about nuclear activities, which may provide reassurance on safety and security.
Factors against disclosure (section 24)
- Information relating to national security could be of use to hostile actors;
- Disclosure of protective security, cyber security, and related information could increase the risk of threats or attacks;
- No evidence of imminent threat is required for this exemption to apply; and
- Adversaries may combine information to identify vulnerabilities.
Factors against disclosure (section 43(2))
- Disclosure of security-related information would prejudice commercial interests;
- The information is commercially sensitive and not in the public domain; and
- Disclosure could affect the commercial case and future operations of GE Vernova Hitachi.
Conclusion
We recognise there is significant public interest in understanding the GE Vernova Hitachi BWRX-300 SMR design. However, after careful consideration, we have determined that the information relating to security and commercially sensitive areas should be withheld.
There is a strong public interest in safeguarding national security and protecting commercial confidentiality. These factors outweigh the benefits of disclosure.
