Aim of inspection

The aim of the inspection is to judge the duty holder's compliance with the CDM Regulations 2015 and LC26 for the Boiler Removal Enabling Works projects.

Key findings, inspector's opinions and reasons for judgement made

This inspection was carried out as part of ONR's assessment of the Dungeness A Boiler Removal Programme Enabling Projects. There are a number of enabling projects in various states of completion ranging from completed, through in progress, to being planned.

The inspection was targeted at two projects in progress and two projects in the planning stage.

The purpose of the inspection was to assess control and supervision of the enabling projects as required under site licence condition 26, and the implementation of the duty holder's (Magnox Ltd) arrangements for management and control of the enabling projects as required by the Construction, Design and Management Regulations 2015 (CDM Regs).

ONR identified examples of adequate control when visiting construction projects during the inspection, however, shortfalls were found within Magnox Ltd's role as a Client as described by the CDM Regs with project design and traffic management on site.

ONR required immediate improvements to be made in traffic management, and informed Magnox Ltd that further improvements would be required. Feedback was given during an inspection close out meeting summarising the required improvements. It was also stated that ONR would apply the ONR Enforcement Management Model, any enforcement outcome would ensure the necessary improvements are adequately made and implemented.

Conclusion

ONR summarised the inspection and informed MxL that it would give the inspection an Amber Rating under the ONR Inspection Rating Guide, highlighting MxL’s shortcomings against the relevant statutory provisions.

ONR also stated that it would apply the Enforcement Management Model to inform regulatory action arising.
