Personal Information under Regulation 13 of Environmental Information Regs 2004 this is an absolute exemption and not subject to the Public Interest Test.

Commercially sensitive material under Regulation 12 (5)(e) - the confidentiality of commercial or industrial information where such confidentiality is provided by law to protect a legitimate economic interest. Use of this exception is subject to a Public Interest Test and that is as follows.

Factors for Disclosure

Issues related to the nuclear industry are subject to close scrutiny and debate, there is public interest in information related to nuclear activities and the release of such information.

Factors for Withholding

The disclosure of commercially sensitive information would prejudice the commercial interests of an individual or body by revealing details of cost of containers, programme dates, deliverable and milestones for Magnox and optioneering of proposals from EDF and other areas currently under discussions.

Conclusion

On balance, it is not in the public interest for the release of commercial information in this case at this time.
